    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN that on April 11, 2016, the Criminal Justice Standards and Training Commission received a petition for a temporary waiver of paragraph 11B-27.002(4)(a), F.A.C., from Allan C. Piggott. The Petitioner wishes to temporarily waive that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that he has successfully completed Commission-approved Correctional Officer Cross-Over training to Florida CMS Law Enforcement Basic Recruit Training Program from May 12, 2011 through November 18, 2011 and achieved a passing score on the State Officer Certification Examination on December 14, 2011. Petitioner states that he has been unsuccessful in gaining employment with several Florida law enforcement agencies however, he is currently in the final stages of the hiring process with the Florida City Police Department and would be appointed as an officer within 45 days of the granting of his waiver request. Petitioner states that strict application of the rule creates a substantial hardship and violates principles of fairness because he would have to retake the Correctional Officer Cross-Over training to Florida CMS Law Enforcement Basic Recruit Training Program and pass the State Officer Certification Examination again which would also cause an economic hardship due to loss of income and a six month leave of absence from his current employer to sponsor himself through the cross-over training. Petitioner states the purpose of the underlying statute would be achieved if the waiver is granted.
