NOTICE IS HEREBY GIVEN that that Construction Industry Licensing Board has declined to rule on the petition for declaratory statement filed by Alan Brotz and Brian Miller on January 12, 2018. The following is a summary of the agency's declination of the petition:

The following is a summary of the agency’s declination of the Petition: The Notice of Petition for Declaratory Statement was published in Volume 44, No. 25, of the February 6, 2018, and Volume 43, No. 155 on July 11, 2017, Florida Administrative Register. Petitioner asks the Board for clarification of subsection 61G4-12.011(15), F.A.C., as it relates to a licensed pool/service contractor installing or replacing electrical circuits on the load side of the dedicated pool equipment disconnect panel when installing or replacing pool equipment. The Board considered the Petition at its meeting held on March 16, 2018, in St. Augustine, FL. The Final Order was filed on April 10, 2018. The Petitioner’s petition appears to apply to the conduct of another, which is inappropriate for a declaratory statement as outlined in Rule 28-105.001, F.A.C., and appears to relate to general applicability, which has previously been addressed in rule. It is the Board’s opinion that subsection 61G4-12.011(15), F.A.C., is not ambiguous, and declines to clarify the rule.
