NOTICE IS HEREBY GIVEN that the Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling has issued an order disposing of the petition for declaratory statement filed by Joseph Sansone on October 25, 2012. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement published on October 31, 2012, in Vol. 38, No. 62, of the Florida Administrative Register. The petition seeks the Board’s interpretation of Section 491.003, Florida Statutes and whether petitioner is allowed to practice hypnotherapy as a Licensed Mental Health Counselor. The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling considered the Petition at a duly noticed public meeting held on February 7, 2013, in Jacksonville, Florida. The Board’s Order filed on March 25, 2013, stated that the Board voted to deny the petition for declaratory statement on the grounds that it does not have the authority or jurisdiction to interpret Chapter 485, Florida Statutes, “the Hypnosis Law;” and the lack of particularity in describing Petitioner’s set of circumstances.
