The Board of Professional Engineers hereby gives notice of the issuance of an Order Granting Petition for Variance or Waiver of Rule 61G15-20.0015, F.A.C., filed on March 27, 2012, by Oswald Pasquesi, P.E., S.E. The Notice of Petition for Variance or Waiver was published in Vol. 38, No. 14, the April 6, 2012 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on May 25, 2012. The Petitioner sought a waiver of the provision of paragraph 61G15-20.0015(1)(a), F.A.C., that applicants for licensure by endorsement meet the current licensure criteria listed in Section 471.013, F.S.; specifically, Petitioner’s undergraduate engineering degree was not EAC/ABET accredited, and therefore was not a degree approved by the Board.

The Board found that the Petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. The Board found that, based on the Petitioner’s submissions and testimony, the Petitioner showed that strict application of the rule would constitute an undue hardship on Petitioner. The Board further found that the applicant achieved the purpose of the underlying statute by other means. The Board approved the Petition for Waiver or Variance of Rule 61G15-20.0015, F.A.C., and further approved the Petitioner’s application for licensure. The Board filed its final order on April 3, 2017.
