    NOTICE IS HEREBY GIVEN that the Department of Education has received the petition for declaratory statement from Rod Hartsook, the Martin County Education Association, and the Florida Education Association on May 8, 2017, which has been assigned DOE case number 2017-3475. The petition seeks the agencs opinion as to the applicability of Section 1012.22(1)(c), Florida Statutes, requiring that district school boards adopt a performance salary schedule for instructional personnel, to the petitioner and the petitioner organization’s members, as it applies to the petitioner.

    The Petition asks the Department to answer one question: Do the requirements of Section 1012.22(1)(c), Fla. Stat., apply to JROTC instructors employed as instructional personnel by the Martin County School Board and/or other district school boards in Florida? Motions to intervene or petitions for administrative hearing by persons whose substantial interests may be affected must be filed with the Agency Clerk of the Department of Education within 21 days after the date of publication of this notice.
