  • Notice of Continuation of the Generic Permit for Discharge of Stormwater from Phase II Municipal Separate Storm Sewer Systems

    The purpose of this notice is to announce the continuation of the Generic Permit for Discharge of Stormwater from Phase II Municipal Separate Storm Sewer Systems (Phase II MS4 GP) under the National Pollutant Discharge Elimination System (NPDES) Stormwater Program (Program). The Florida Department of Environmental Protection (Department) provides this notice to comply with the Memorandum of Agreement between the Department and the U.S. Environmental Protection Agency Region 4.

    The Department regulates municipal stormwater discharge through the Program pursuant to Florida Administrative Code (F.A.C.) Chapters 62-4, 62-620, 62-621 and 62-624, F.A.C. To regulate stormwater discharges associated with small municipal separate storm sewer systems, the Department adopted and incorporated by reference the Phase II MS4 GP found at paragraph 62-621.300(7)(a), F.A.C. The current Phase II MS4 GP became effective on May 1, 2003.

    Permit coverage under the Phase II MS4 GP is limited to a term not to exceed five years from the effective date of coverage. It is not scheduled to be reissued every five years. The Department reviews and evaluates the provisions of the Phase II MS4 GP on a regular basis and will amend the Phase II MS4 GP as needed to account for changes in technology, federal regulations or to better protect the State’s water resources. The Phase II MS4 GP may be re-opened at anytime by the Department or any substantially affected person may propose a rule change in accordance with Section 120.54(7), Florida Statutes.
