The purpose of this notice is to announce the continuation of the Generic Permit for Stormwater Discharge from Large and Small Construction Activities (CGP) under the National Pollutant Discharge Elimination System (NPDES) Stormwater Program (Program). The Florida Department of Environmental Protection (Department) provides this notice to comply with the Memorandum of Agreement between the Department and the U.S. Environmental Protection Agency Region 4.
The Department regulates stormwater runoff through the Program pursuant to Chapters 62-4, 62-620, 62-621 and 62-624, Florida Administrative Code (F.A.C.). To regulate stormwater discharges associated with large and small construction activities, the Department adopted and incorporated by reference the CGP found at paragraph 62-621.300(4)(a), F.A.C. The current CGP became effective on May 1, 2003.
Permit coverage under the CGP is limited to a term not to exceed five years from the effective date of coverage. Unlike the Federal stormwater general permit, the CGP is not scheduled to be reissued every five years. The Department reviews and evaluates the provisions of the CGP on a regular basis and will amend the CGP as needed to account for changes in technology, federal regulations or to better protect the States water resources. The CGP may be re-opened at anytime by the Department or any substantially affected person may propose a rule change in accordance with Section 120.54(7), Florida Statutes.
