    5N-1.140Security Officer, Recovery Agent and Private Investigative Intern School Curriculum; Examinations; Retention of Records

    The Division of Licensing hereby gives notice that on May 18, 2016, the Department issued an Order, granting in-part and denying in-part, a petition for variance filed by The Security Training Group on February 22, 2016. Notice of the Petition was published on April 21, 2016, in Volume 42, No. 78, of the Florida Administrative Register. Petitioner sought a variance from paragraph 5N-1.140(1)(b), F.A.C., establishing criteria for administering a two-part final examination upon completion of the 40-hour Security Officer Training course. The Security Training Group was granted its request to vary paragraph (1)(b), allowing examinations to be administered at various intervals. The Division also found it necessary to grant Petitioner a variance from paragraph (1)(c) which also referenced a two-part examination. The Division denied Petitioner’s request to record examination results as either pass or fail as the rule calls for all scores to be tallied, with 128 out of 170 questions answered correctly to achieve a passing score.
