    NOTICE IS HEREBY GIVEN that the Department of Health has issued an order disposing of the petition for declaratory statement filed by Seacrest Beach II Owner’s Association, Inc., on December 29, 2015. The following is a summary of the agency’s disposition of the petition:

    The Notice of Petition for Declaratory Statement was published in Vol. 42, No. 47, of the March 9, 2016, Florida Administrative Register. An amended notice was published on March 11, 2016, in Vol. 42, No. 49, Florida Administrative Register. The Petitioner, who has a publicly recorded beach access easement, sought clarification from the Department on the applicability of Rules 64E-9.013 and 64E-10.002, of the Florida Administrative Code, to the beach access easement. The Department considered the petition and, in an order filed May 03, 2016, stated that, under the specific facts of the petition, the requirements for sanitary fixture ratios under Rules 64E-9.013 and 64E-10.002, do not apply to the beach access easement.
