NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Joel Martin McTague, Esq. on behalf of Mariela Perez and Jesus Mayan, In Re: Ocean Isles Fishing Village, Inc., Docket No. 2018022912, filed on April 25, 2018. The petition seeks the agency’s opinion as to the applicability of Sections 718.111(11), 718.113, and 718.117, Florida Statutes, as it applies to the petitioner.

Whether the Association, pursuant to Sections 718.111(11), 718.113, and 718.117, Florida Statutes, may reconstruct the condominium, after a casualty loss, in a manner different from the way in which the condominium was originally constructed or previously approved without a vote of the unit owners.
