The Department of Children and Families hereby gives notice: The Department of Children and Families hereby gives notice: An order has been issued disposing of the petition for waiver of paragraph 65D-30.0046(4)(a), Florida Administrative Code, from the Polk County Problem Solving Courts on behalf of Gareth Washington. The Notice of Variances and Waivers was published in Vol. 49, No. 59 of the Florida Administrative Register on March 27, 2023. paragraph 65D-30.0046(4)(a) prohibits specified unlicensed staff from performing tasks not specifically delineated in section (3) of the rule.
The petition for waiver was granted on the condition that, within 18 months, Mr. Washington demonstrates to the Department that he has attained all the eligible training from a Florida Certification Board (“FCB”) Approved Education Provider and is documenting on-the-job supervision as required by the FCB. Petitioner demonstrated a potential violation of principles of fairness and that the underlying purpose of the statutes will be achieved if this condition is met.
