    RULE NO.: RULE TITLE:

65D-30.003 Department Licensing and Regulatory Standards

The Department of Children and Families hereby gives notice:

An order was issued disposing of the petition for waiver of paragraph 65D-30.003(1)(b), Florida Administrative Code, from Aware Recovery Care of Florida, LLC. The Notice of Petition for Waiver was published on March 1, 2023, in Volume 49, Number 41 of the Florida Administrative Register. Paragraph 65D-30.003(1)(b) states, in pertinent part, that the Department issues one license for each service component. A separate license is not required for the same component. A license is valid only for the specific service component listed for each specific location identified on the license. Each location listed on the license shall reflect the license type for that component. One (1) license is required where all facilities are maintained on the same premises and operated under the same management. If there are multiple buildings on the same premises, the buildings must appear as part of one (1) entity.

The petition for waiver was denied as unnecessary, provided Petitioner’s license reflects approval to serve all 67 counties in accordance with s. 397.407(6), Fla. Stat.
