    NOTICE IS HEREBY GIVEN that Board of Physical Therapy Practice has issued an order disposing of the petition for declaratory statement filed by Diane Laurice, PTA on September 21, 2012. The following is a summary of the agency's disposition of the petition:

    The Notice of Petition for Declaratory Statement was published in Volume 38, No. 59, of the October 26, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 2, 2012. The Petitioner requested the Board’s interpretation of Section 486.021(11), Florida Statutes, and whether it is within the scope of practice “for a PT or PTA to take a patient’s blood pressure (manual or digital), Heart Rate, SAT level with a Pulse Ox, and to auscultate lungs with a stethoscope during their PT treatment as deemed necessary in the PT or PTA’s judgment.” The Board’s Order, filed on November 19, 2012, denies the Petition for Declaratory Statement. The Petition is asking for clarification of the statutory provision and rules to determine conduct that has already occurred. This type of clarification is not appropriate for determination by declaratory statement.
