Board of Physical Therapy Practice

NOTICE IS HEREBY GIVEN that Board of Physical Therapy Practice has issued an order disposing of the petition for declaratory statement filed by Rodolfo Freire, M.D. on August 28, 2012. The following is a summary of the agency's disposition of the petition: the Notice of Petition for Declaratory Statement was published in Volume 38, No. 36, of the September 7, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on September 17, 2012. The Petitioner requested the Board’s interpretation of Sections 486.028, 486.135, 486.151, 486.161, Florida Statutes, in regards to supervision of a licensed massage therapist performing delegated duties under the direction of a licensed physical therapist and a licensed medical doctor. The Board’s Order, filed on October 2, 2012, denies the Petition for Declaratory Statement. The Petitioner is not a Licensed Physical Therapist, and is not subject to the disciplinary guidelines of Chapter 486, Florida Statutes. The Petition is asking for clarification of the statutory provisions and rules to determine the conduct of another person within Petitioner’s clinic in accordance with his plan for offering services within his clinic. This type of clarification is not appropriate for determination by declaratory statement.
