The Board of Massage Therapy hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on November 8, 2013, by Jo Amy Owen. The Notice of Petition for Waiver or Variance was published in Vol. 39, No. 226, of the November 20, 2013, Florida Administrative Register. Petitioner sought a waiver or variance of Section 480.044(1)(e), Florida Statutes, which requires the Board to impose a renewal fee for the renewal of a massage establishment license The Petitioner seeks a waiver of the renewal fee and delinquency fees due to a financial hardship. The Board considered the instant Petition at a duly-noticed public meeting held on December 11, 2013, by telephone conference call.
The Board’s Order, filed on December 27, 2013, denied the petition because Section 120.565, Florida Statutes, does not permit the Board to waive statutory requirements.
