NOTICE IS HEREBY GIVEN that Agency for Health Care Administration has declined to rule on the petition for declaratory statement filed by Alternative Outcomes, Inc. on April 28, 2015. The following is a summary of the agency’s declination of the petition:

The Notice of Petition for Declaratory Statement was published in Vol. 41, No. 88, of the Florida Administrative Register. The Petition seeks an interpretation of the place of service definitions and service limitations for reimbursement of Applied Behavior Analysis services provided by Developmental Disabilities Waiver providers to Medicaid recipients. The Petition fails to identify the statutory provision, rule or order that applies to the petitioner’s particular set of circumstances as required by Section 120.545, Florida Statutes and, therefore, the Petition is denied.
