NOTICE IS HEREBY GIVEN that the Board of Pharmacy has issued an order disposing of the petition for declaratory statement filed by Mark T. Mason, PharmD on May 12, 2014. The following is a summary of the agency's disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 40, No. 98, of the May 20, 2014, Florida Administrative Register. The Petitioner sought a Declaratory Statement from the Board with regard to impending medical marijuana legislation and the impact it will have on the practice of pharmacy. The Board of Pharmacy considered the Petition at a duly-noticed public meeting held on June 10, 2014, in Kissimmee, Florida. The Board’s Order, filed on July 9, 2014, found that based on laws and rules, it would not be legally appropriate for the Board to issue a Declaratory Statement in this cause. Therefore, the Board declines to answer the Declaratory Statement.
