    11B-35.002Basic Recruit Training Programs for Law Enforcement, Correctional, and Correctional Probation

    NOTICE IS HEREBY GIVEN that on July 9, 2015, the Criminal Justice Standards and Training Commission received a petition for a waiver of paragraph 11B-35.002(2)(a), F.A.C., from the Miami-Dade Corrections and Rehabilitation Department on behalf of Venda Milton. The Petitioner wishes to waive that portion of the rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination (SOCE) pursuant to Rule 11B-30.0062, F.A.C., and gain employment and certification as an officer. Petitioner states that Ms. Milton began the Correctional Officer basic recruit program with the Miami-Dade Corrections and Rehabilitation Department on February 23, 2010. Petitioner states that Ms. Milton was unable to complete the basic recruit program in part because of an injury. Petitioner states that Ms. Milton subsequently completed the program on March 30, 2011 and passed the State Officer Certification Exam on May 25, 2011.

    Petitioner states that Ms. Milton applied for employment as a certified correctional officer with the Miami-Dade Corrections and Rehabilitation Department on August 10, 2013. Petitioner states that because of a hiring freeze and application processing delays, Ms. Milton was not approved for employment until February 2, 2015. Petitioner states that due to an administrative oversight it was believed that Ms. Milton had until May 25, 2015 to become employed; however, the four-year grace period ran out on February 23, 2014. Petitioner states that Miami-Dade Corrections and Rehabilitation Department has an immediate need for Ms. Milton as a certified corrections officer; the purpose of the underlying statute would be served if the waiver is granted and a strict application of the rule would result in unreasonable, unfair and unintended results in this instance.
