    NOTICE IS HEREBY GIVEN that on June 9, 2015, the Criminal Justice Standards and Training Commission received a petition for a waiver of paragraph 11B-27.002(4)(a), F.A.C., from Alton K. Williams, III, Chief of Police, Live Oak Police Department on behalf of Terry Carton. The Petitioner wishes to waive that portion of the rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that Mr. Carlton began a Commission-approved Correctional Cross-Over Basic Recruit training on September 13, 2011 and completed such on September 13, 2011.

    Petitioner states that he was attempting to hire Mr. Carlton with the reserve unit but due to budget considerations, the process was delayed until the following budget year and Mr. Carlton was hired on a Temporary Employment Authorization on November 13, 2014. Petitioner states that all documents establishing Mr. Carlton’s compliance with Section 943.13, F.S. have been completed. Petitioner states the purpose of the underlying statute would be served if the waiver is granted and a strict application of the rule would result in a substantial financial hardship for Mr. Carlton creating an unreasonable, unfair and unintended result in this instance.
