NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Josaphat J. Celestin on March 11, 2015. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Volume 41, No. 61, of the March 30, 2015, Florida Administrative Register. The Petitioner asks the Board for clarification of Sections 489.105(3)(a), (b), (c), F.S., as to whether licensure under the aforementioned sections of the Florida Statutes is sufficient to qualify an individual to be a construction compliance manager, or whether a local municipality may require that manager to be a professional engineer. The Board’s Order, filed on June 25, 2015, declines to issue a declaratory statement in this matter because the matter is related to foreseeable litigation.
