The Petitioner is an inmate of the Florida Department of Corrections. Pursuant to section 120.81(3), F.S., inmates may only participate in administrative proceedings that are brought pursuant to sections 120.54(3)(c) and (7), Florida Statutes. Pursuant to section 120.81(3), Florida Statutes, the Petitioner lacks standing to bring a Petition for Declaratory Statement, and the Department lacks jurisdiction to issue a declaratory statement in this case.
