    NOTICE IS HEREBY GIVEN that the Department of Financial Services has received the petition for declaratory statement from William Harrison, Fire Marshal, Clermont Fire Department, on July 25, 2013.The petition seeks the agency's opinion as to the applicability of Subsection 60.1.24(3) of NFPA 1, Uniform Fire Code, Florida Edition, as it applies to the petitioner.

    The petition seeks the agency’s opinion as to whether the property setback requirements of Subsection 60.1.24(3) of NFPA 1, Uniform Fire Code, Florida Edition, apply to an above ground storage tank holding an aqueous solution of sodium hypochlorite since sodium hypochlorite is exempted by paragraph 62-762.301(2)(y), Florida Administrative Code, from regulation as a pollutant or hazardous substance under Chapter 376, Florida Statutes, and Rule Chapter 62-762, Florida Administrative Code; whether the intent of Chapter 60 of NFPA 1, Uniform Fire Code, Florida Edition, is to regulate sodium hypochlorite as a corrosive; and if setback requirements apply, are there alternatives to imposing a 20 foot setback, in accordance with Subsection 60.1.24(3) of NFPA 1, Uniform Fire Code, Florida Edition, other than a two hour firewall.
