NOTICE IS HEREBY GIVEN that the Department of Health has declined to rule on the petition for declaratory statement filed by Petitioners, Blue Seven, LLC and Matthew and Jacqueline Stewart on April 20, 2020. The following is a summary of the agency's declination of the petition:
The petition sought the department's opinion as to the applicability of Sections 386.01, 386.041, subsection 514.011(2), and Sections 514.031 and 514.0315, Florida Statutes, to Petitioners' circumstances. Petitioners have already begun operations without Department-issued permits, leading to enforcement actions by the Department and currently pending litigation. Therefore, the conduct at issue has already occurred and cannot be the basis for a declaratory statement. The Department's order dismissing the petition was issued on July 16, 2020.
