NOTICE IS HEREBY GIVEN that Division of Alcoholic Beverages and Tobacco, Department of Business and Professional Regulation, State of Florida has received the petition for declaratory statement from Kathouse Saloon, Inc. d/b/a Roadside Tavern’s DS 2013-007, on August 26, 2013. The petition seeks the agency's opinion as to the applicability of Florida Statues 849.08 and 849.16 as it applies to the petitioner.

The Petitioner’s proposed video game machines involve table-top games which require players to line up three of the same object (fruit, assorted shapes, sports objects, etc.) in a row. The Petitioner requests the Division's interpretation as to whether the foregoing games constitute illegal gambling under the relevant statues outlined herein. The Petitioner wishes to avoid any violations of the foregoing statutory authorities, which govern the right to possess, operate and offer to the public computerized video games on it business premises. The Petitioner is substantially affected concerning the applicability of the foregoing statutory provisions over which the Division has authority and seeks a declaratory statement from the Division prior to acquiring, installing and making such games available to the public.
