    NOTICE IS HEREBY GIVEN that the Department of Agriculture and Consumer Services, Division of Licensing, has declined to rule on the petition for declaratory statement filed by JTDA Group, Inc., and Eduardo Wolmers on August 28, 2014. The following is a summary of the agency’s declination of the petition:

    Notice of the Amended Petition for Declaratory Statement was published on July 14, 2014, in Vol. 40, No. 135, of the Florida Administrative Register. The Petition sought a declaration regarding subsections 493.6101(22), 493.6120(1), and paragraph 493.6118(1)(n), or other provision of Chapter 493, Florida Statutes, as they relate to forwarding companies and licensed recovery agents. Petitioner’s questions asked whether the practice of forwarding and forwarding companies are in violation of Chapter 493 Florida Statutes; and conversely, whether Florida licensed recovery agents engaged in forwarding contracts are violating the chapter’s requirements. The Department’s order, filed on August 28, 2014, declined to answer the petition as it failed to ask how the statutory provisions in question affect the Petitioner’s particular set of circumstances, but instead, asked questions regarding the conduct of other persons.
