    Board of Physical Therapy Practice

    NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has issued an order disposing of the Petition for Declaratory Statement filed by Shawn Mollin, P.T., on June 3, 2014. The Notice of Declaratory Statement was published on June 24, 2014, in Vol. 40, No. 122, of the Florida Administrative Register. Petitioner sought the Board’s interpretation of subsection 486.021(11), F.S., entitled “Definitions (Practice of Physical Therapy).Petitioner sought a determination regarding whether practicing Telehealth is allowed under a Florida Physical Therapy license. The Board considered the Petition at a duly-noticed public meeting held on August 8, 2014, in St. Augustine, Florida.

    The Board’s Order, filed August 27, 2014, declined issuance of the requested statement finding that Petitioner is not a substantially affected person as that term is used in Section 120.542, F.S., since he is not currently licensed, nor is he currently seeking licensure, as a physical therapist in Florida. Furthermore, the Board found that the Petitioner failed to allege any facts and circumstances unique to Petitioner's particular circumstances.
