NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has issued an order disposing of the petition for declaratory statement filed by John Nicholas Datesh, Jr., Petitioner/Unit Owner, In Re: Botanical Place Condominium Association, Inc., Docket No. 2015027097, on July 13, 2015. The following is a summary of the agency’s disposition of the petition:

The Association may impose a fee upon a unit owner for a requested print out of an official record accessible only on a computer screen, pursuant to Section 718.111(12)(b) and (c), Florida Statutes. The Association may impose a fee upon a unit owner making an electronic copy of an official record accessible only on a computer screen, pursuant to Section 718.111(12)(c), Florida Statutes. The Division declined to answer whether the Association may impose a charge on a copy of an official record that exceeds the actual cost to the Association for that copy because the specified statute is inapplicable, and the petition does not provide sufficient facts to issue a statement. The amended statement was filed with the Agency Clerk on September 14, 2015. The original statement was amended slightly to clarify the Findings of Fact.
