NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Tyler Edwards, on May 23, 2017. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement was published June 15, 2017 in Vol. 43, No. 116 of the Florida Administrative Register. Petitioner asked the Board for Clarification of s. 489.105(3)(d), Fla. Stat., specifically “whether a certified sheet metal contractor is authorized to install, maintain, repair, alter, extend, and design ventilate commercial hood systems including ductwork in connection with a complete hood system.” The Petitioner’s request for clarification is vague and facially insufficient and appears to apply to the conduct of a third party. It is the Board’s opinion that s. 489.105(3)(d), Fla. Stat. is not ambiguous, and declines to clarify the statute. The Board’s Order, filed on September 22, 2017, declines to issue a declaratory statement in this matter.
