    14-57.013Installation Criteria and Warning Devices for Public Railroad-Highway Grade Crossings

    The Department of Transportation hereby gives notice that on April 2, 2015, the Department of Transportation entered an Order Granting Petition for Variance in response to a request filed by Jacksonville Port Authority (JAXPORT), for a variance from the provisions of subsection 14-57.013(2), F.A.C. The Petitioner specifically requests a temporary variance from the installation of roadside flashing lights and gates on a new public road railroad grade crossing in Duval County. The petition was received by the Department on February 12, 2015. The Department published its notice of receipt of the Petition in the February 26, 2015, edition of the F.A.R. The Department granted the Petition because JAXPORT has demonstrated that the strict application of subsection 14-57.013(2), F.A.C., would create a substantial hardship on JAXPORT and would result in an unreasonable and unfair result in this particular instance.
