    PUBLIC SERVICE COMMISSION

    The Florida Public Service Commission hereby gives notice:

    that 4000 South Ocean Property Owner, LLLP’s petition for variance or waiver from subsections 25-6.049(5) and (6), Florida Administrative Code, filed May 7, 2018, in Docket No. 20180113-EU was granted by the Commission by Order No. PSC-2018-0351-PAA-EU, issued July 18, 2018, and consummated by Order No. PSC-2018-0396-CO-EU, issued August 9, 2018. Subsection 25-6.049(5), F.A.C., sets forth the conditions under which individual occupancy units in residential and commercial buildings must be metered for electricity use and establishes the criteria for exemptions to the individual metering requirement. Subsection 25-6.049(6), F.A..C., states that in addition to satisfying the criteria in paragraph 25-6.049(5)(g) and subsection 25-6.049(6), F.A.C., the owner or developer of the condominium association, or the customer, must attest to the utility that the criteria have been met. The petition was approved on the basis that the purpose of the underlying statute would be achieved by other means and application of the rule would create a substantial hardship and violate principles of fairness.  Notice of the petition was published in the FAR on May 15, 2018, Vol. 44/95.
