62-214.330. Acid Rain Compliance Plan and Compliance Options  


Effective on Sunday, March 16, 2008
  • 1(1) The designated representative shall submit to the Department a complete Acid Rain compliance plan for each Acid Rain unit included in an Acid Rain Part application, including:

    29(a) For sulfur dioxide emissions, a certification that, the designated representative will hold allowances, as defined at 4640 C.F.R. 72.2, 49adopted and incorporated by reference at Rule 5662-204.800, 57F.A.C., as of the allowance transfer deadline, as defined at 6740 C.F.R. 72.2, 70not less than the total annual emissions of sulfur dioxide from the unit for the previous calendar year and shall comply with the unit’s elected compliance options, if any. Such requirement shall become effective on:

    1051. January 1, 2000, for an Acid Rain unit that is an existing unit pursuant to 12140 C.F.R. 72.6(2), 124adopted and incorporated by reference at Rule 13162-204.800, 132F.A.C.;

    1332. The deadline for monitor certification pursuant to 14140 C.F.R. Part 75, 145adopted and incorporated by reference at Rule 15262-204.800, 153F.A.C., for an Acid Rain unit that is a new unit as defined at 16740 C.F.R. 72.6(3), 170adopted and incorporated by reference at Rule 17762-204.800, 178F.A.C.;

    1793. The deadline for monitor certification pursuant to 18740 C.F.R. Part 75, 191adopted and incorporated by reference at Rule 19862-204.800, 199F.A.C., for an Acid Rain unit that is an opt-in source as defined at 21340 C.F.R. 72.2, 216adopted and incorporated by reference at Rule 22362-204.800, 224F.A.C.

    225(b) For nitrogen oxides emissions, a certification that the unit will comply with any applicable limitation established by the EPA pursuant to 24740 C.F.R. Part 76.5, 25176.6, or 76.7, adopted and incorporated by reference at Rule 26162-204.800, 262F.A.C., or will elect and comply with one or more Acid Rain compliance options in accordance with the provisions of 28240 C.F.R. Part 76.10 286and 28776.11, 288adopted and incorporated by reference at Rule 29562-204.800, 296F.A.C.

    297(2) The designated representative may include in the Acid Rain compliance plan a multi-unit compliance option pursuant to the requirements of 31840 C.F.R. 76.11, 321adopted and incorporated by reference at Rule 32862-204.800, 329F.A.C., provided that:

    332(a) A plan for a compliance option that includes units at more than one Acid Rain source shall be complete only if:

    3541. Such plan is signed and certified in accordance with Rule 36562-214.350, 366F.A.C., by the designated representative for each source with an Acid Rain unit governed by such plan; and

    3842. A complete Title V permit application including an Acid Rain Part application is submitted covering each unit governed by such plan.

    406(b) The designated representative of the source containing the unit or units covered by the Acid Rain Part application certifies that every permitting authority (as defined at 43340 C.F.R. 70.2, 436adopted and incorporated by reference at Rule 44362-204.800, 444F.A.C.) with jurisdiction over any other units included in the multi-unit compliance option has approved the Acid Rain compliance plan with the same modifications or conditions, if any, stated in the proposed Acid Rain Part of the permit or submits a schedule in the form of a Title V compliance plan for providing such certifications.
