34FINAL ORDER

36On January 11, 1999, Petitioner Hayes Group Home, Inc.,

45filed its Renewed Petition for Attorneys' Fees and Costs pursuant

55to Section 57.111, Florida Statutes. On February 2, 1999,

64Respondent Agency for Health Care Administration filed its

72Memorandum in Opposition to Petitioner's Renewed Petition for

80Attorney's Fees and Costs. Although both parties requested an

89evidentiary hearing on Petitioner's entitlement to be reimbursed

97for its costs and attorney's fees incurred in the underlying

107proceeding, there are material facts not in dispute which are

117dispositive of this proceeding without the necessity for an

126evidentiary hearing.

128The following relevant dates are not in dispute. By letter

138dated November 12, 1996, the Agency advised Petitioner that its

148application for licensure as an assisted living facility was

157denied, and Petitioner timely requested an administrative hearing

165regarding that denial. The matter was transferred to the

174Division of Administrative Hearings in January 1997 and was

183assigned DOAH Case No. 97-0162. The DOAH proceeding culminated

192in a Recommended Order on July 18, 1997, recommending that

202Petitioner's application be granted subject only to Petitioner

210providing to the Agency a certain inspection report.

218The Agency's September 16, 1997, Final Order did not adop t

229the recommendation in the Recommended Order. Rather, the Agency

238concluded that Petitioner's application should be further

245considered by Agency staff. The Final Order did not grant

255Petitioner's application for licensure. Petitioner appealed that

262Final Order to the District Court of Appeal of Florida, Fourth

273District.

274By letter dated April 10, 1998, the Agency forwarded to

284Petitioner a standard license to operate as an assisted living

294facility for the period of March 19, 1998, through March 18,

3052000. On November 5, 1998, Petitioner filed a Notice of

315Voluntary Dismissal of its appeal.

320The Agency's Memorandum in Opposition to Petitioner's

327Renewed Petition for Attorney's Fees and Costs opposes

335Petitioner's request for attorney's fees and costs on four bases,

345one of which is that the request is not timely made. The

357Agency's argument is both meritorious and dispositive of this

366proceeding.

367Section 57.111(4)(b)2, Florida Statutes, requires that the

374application for an award of attorney's fees and costs be made

385within 60 days after the date on which the small business party

397becomes a prevailing party. In this cause, the underlying

406proceeding involved Petitioner's application for licensure.

412According to the Renewed Petition for Attorneys' Fees and Costs,

422Petitioner received its license to operate an assisted living

431facility by transmittal letter dated April 10, 1998. That is the

442date upon which Petitioner obtained the relief sought by

451Petitioner in the underlying proceeding. Since more than 60 days

461elapsed between April 10, 1998, the date on which Petitioner's

471application for licensure was granted, and January 11, 1999, the

481date on which Petitioner filed its Renewed Petition for

490Attorneys' Fees and Costs, the Petition filed in this cause is

501untimely.

502In its Reply Memorandum in Support of Its Renewed Petition

512for Attorneys' Fees and Costs, Petitioner admits that the

521granting of a license to Petitioner rendered moot Petitioner's

530appeal of the Agency's Final Order in the underlying proceeding.

540Petitioner argues, however, that its Petition in this cause was

550filed timely because it was filed within 60 days of November 5,

5621998, the date on which Petitioner filed its Notice of Voluntary

573Dismissal of its appeal. Petitioner offers no explanation as to

583why it waited almost seven months from when its appeal became

594moot until it dismissed its appeal.

600The date on which Petitioner obtained the relief it sought

610is the dispositive date, not the date on which Petitioner advised

621the appellate court that Petitioner's appeal had been rendered

630moot seven months earlier. Further, Petitioner did not receive

639the relief it sought in the underlying proceeding as a result of

651the appellate court proceedings. Accordingly, the appeal does

659not provide the relevant dates for determining the timeliness of

669the Petition filed in this cause.

675Petitioner's further argument that until it advised the

683appellate court that the appeal had been rendered moot, its time

694for filing its petition in this cause did not commence to run but

707rather was tolled because the appellate court had jurisdiction

716over Petitioner's dispute with the Agency is without merit.

725Petitioner's Reply Memorandum attaches (1) a copy of Petitioner's

734own request filed with the appellate court on or about

744January 13, 1998, requesting the appellate court to relinquish

753jurisdiction while Petitioner's application for licensure was

760further considered by the Agency and (2) a copy of the Court's

772Order entered February 4, 1998, granting that request.

780On February 23, 1999, the Ag ency filed its Motion to Strike

792Petitioner's "Notice of Intent to File Supplemental Memorandum of

801Law in Support of Petition for Attorney's Fees," arguing that a

812reply to an agency's response to a petition for attorney's fees

823and costs pursuant to Section 57.111, Florida Statutes, is not an

834authorized pleading. Although the Agency is correct in its

843argument, in this cause Petitioner's Reply Memorandum has been

852helpful in setting forth Petitioner's arguments regarding the

860issue raised by the Agency in its response to the petition as to

873whether the petition in this cause was timely. Further, it is

884appropriate to allow Petitioner to respond to the Agency's

893arguments where an issue is dispositive of the proceeding without

903the necessity for an evidentiary hearing as to facts in dispute.

914It is, therefore,

917ORDERED THAT:

9191. Respondent Agency for Health Care Administration's

926Motion to Strike Petitioner's "Notice of Intent to File

935Supplemental Memorandum of Law in Support of Petition for

944Attorney's Fees" be and the same is hereby denied.

9532. Petitioner's Renewed Petition for Attorneys' Fees and

961Costs be and the same is hereby denied.
