53ER13. Emergency Rule For Year 2013 |
1(1) The Florida Lottery will conduct, as a retailer sales incentive, a 13Retailer 14MEGA MILLIONS® 16Bonus Commission Program (“Program”) 20in which the Florida Lottery will award bonus commissions to 30Florida Lottery 32retailers 33who 34sell a winning jackpot 38MEGA MILLIONS 40ticket for a 43Tuesday 44or 45Friday 46MEGA MILLIONS 48drawing.
49(2) 50The bonus com53mission will start at $10,000 59for a $6215 63million starting jackpot66. 67In the event no winning jackpot ticket is sold for 77a MEGA MILLIONS 80drawing, the bonus commission amount will increase by $5,000 per 91drawing until a winning jackpot ticket is sold, 99up to a maximum bonus commission of $107100,108000.
109(3) 110If multiple winning jackpot tickets are sold 117in Florida 119for the same 122MEGA MILLIONS 124drawing, the retailers selling such tickets will share the bonus commission. Each retailer selling a winning jackpot ticket will receive a share of the bonus equal to the number of winning jackpot tickets sold by that particular retailer divided by the total number of winning jackpot 170tickets sold 172in Florida 174for that drawing.
177(4) 178If a 180winning jackpot ticket 183i184s a MEGA MILLIONS with Megaplier® ticket, an additional $5,000 bonus commission will be paid to 201the 202retailer 203selling such ticket. 206If multiple winning jackpot tickets are MEGA MILLIONS with Megaplier tickets, each retailer selling such a ticket will be paid the additional bonus commission.
230(2315232) Florida Lottery retailers who sell a 239MEGA MILLIONS 241ticket that 243matches 2445245+0 numbers 247will receive a $1,000 252bonus commission.
254(6) Florida Lottery retailers who sell a 261MEGA MILLIONS 263with Megaplier® 265ticket that matches 5+0 numbers will receive a $2,000 275bonus commission.
277(2787279) 280Award of a bonus commission is not dependent upon the 290MEGA MILLIONS 292winning jackpot ticket, 295MEGA MILLIONS 5+0 winning ticket or 301MEGA MILLIONS 303with Megaplier 5+0 winning ticket 308being claimed by the winner.
313(3148315) 316Retailers whose Florida Lottery contracts are terminated or inactivated prior to the bonus commission award shall be paid the bonus commission earned provided said termination or inactivation was not due to noncompliance with Chapter 24, 351F.S352., 353Chapter 53, 355F.A.C. 356or contract terms.
359(3609361) 362A bonus commission will be considered compensation to the retailer for Inte374rnal Revenue Service purposes. 378The Florida Lottery reserves the right to apply a bonus commission earned against a retailer’s outstanding debt to the Florida Lottery, and to award the remaining balance of 406the bonus commission, if any.
411(41210413) 414MEGA MILLIONS 416bonus commissions are subject to availability of funds appropr425iated for retailer incentives. 429This Program is subject to cancellation by future emergency rule if retailer incentive funding is not appropriated or if the Florida Lottery determines that it is no longer in the state’s best interest to use such funds for this purpose.
