59A-4.165. Nursing Home Guide  


Effective on Monday, December 21, 2015
  • 1(1) Pursuant to Section 5400.191 F.S., 7the Agency shall 10publish the Nursing Home Guide quarterly in electronic form 19to assist consumers and their families in comparing and evaluating nursing home facilities. 32The Nursing Home Guide or “Guide,” is available on the web at http://www.floridahealthfinder.gov/LandingPages/NursingHomeGuide.aspx.

    46(2) The electronic Guide shall include the following:

    54(a) The ability to search for a nursing home;

    63(b) General guidance about when a nursing home is the appropriate choice of care;

    77(c) General guidance about selecting a nursing home;

    85(d) Contact information such as phone numbers and web sites where questions can be answered, and further information can be obtained.

    106(e) A listing of all nursing home facilities in the State of Florida, including hospital based skilled nursing units. This listing shall include for each nursing home the following:

    1351. Name;

    1372. Address;

    1393. Telephone numbers;

    1424. Web address of facility;

    1475. A recognition if the 152nursing home licensee 155has been awarded a Gold Seal;

    1616. The current licensee;

    1657. Which calendar year the current licensee became the licensee;

    1758. Whether the licensee is a for-profit, or non-profit entity, and whether or not the 190nursing home 192is part of a retirement community;

    1989. Any corporate or religious affiliations;

    20410. The number of private, semi-private, and total beds at the 215nursing home;

    21711. The lowest daily charge for a semi-private room;

    22612. The payment forms accepted;

    23113. Any special services or amenities, or recreational programs provided;

    24114. Any non-English languages spoken by the administrator or staff of the 253nursing home255.

    256(f) Details of each deficiency the nursing home has been cited for over the time period specified in Section 275400.191, F.S.

    277(3) The format of the published Guide is shown in the Nursing Home Guide Methodology, which is located on the web 298at 299http://www300.floridahealthfinder.gov/Comparecare/MethodologyNH.aspx.

    301(4) The Guide will employ a procedure for summarizing the deficiencies as follows:

    314(a) All deficiencies cited over the most recently available 323time period as specified in Section 329400.191, F.S., 331prior to the publication of the Guide will be collected.

    341(b) Each citation will be assigned points based on the type of deficiency and its assigned severity and scope. For those 362nursing homes 364that are not federally certified, each citation will be assigned points based on the type of deficiency and its assigned class. 385Nursing homes 387that are federally certified have their deficiencies 394cited using federal 397F-Tags and K-Tags. 400Nursing homes 402that are not federally certified 407have their deficiencies cited using state 413N-Tags and K-Tags. For the non-federally certified 420nursing homes, 422each 423cited state 425N-Tag 426or K-Tag 428shall be 430reviewed 431by the Agency to determine which 437federal 438F-Tag or K-Tag 441the state tag 444is equivalent to. The points assigned to a state tag N-Tag 455or K-Tag 457shall be those that would be assigned to the equivalent 467federal 468F-Tag or K-Tag, if the 473nursing home 475were federally certified.

    478(c) A score for a 483nursing home 485will be computed by summing the points of all of its citations, and then dividing this sum by the number of recertification surveys conducted during the period as in paragraph (a) above. For those facilities that are not federally certified, the number of surveys will be used in place of the number of recertification surveys. 540For current non-federally certified nursing homes that become federally-certified nursing homes, a combination of the non-federally certified citation score and the federally-certified citation score will be utilized.

    567(d) For federally certified 571nursing homes, 573the above computations will reflect any changes resulting from the Informal Dispute Resolution process, or administrative or appellate proceedings; inasmuch as the federal 596Centers for Medicare and Medicaid Services 602concurs with such changes.

    606(e) The scores for the freestanding nursing homes will be ranked within each region. The regions are defined in the Nursing Home Guide Methodology.

    630(f) These ranks shall be presented numerically or symbolically in the Guide.

    642(g) Paragraphs (b) through (f) shall be repeated for 651Components of Inspection which are 656subsets of the citations. 660Components of inspection 663are discussed in the Nursing Home Guide 670Methodology. The subsetting of the tags for non-certified nursing homes shall be accomplished by using the equivalent federal F-Tags and K-tags.
