Nature of the rule for which variance or waiver is sought: Minimum educational requirements for adjunct instructors in Emergency Medical Services training programs.

General basis for agency decision: Petitioner has shown that the purpose of the underlying statute will be met by temporarily varying the rule to permit adjunct faculty who do not possess at least an associate degree to provide instruction in Petitioner’s Emergency Medical Services training program on the condition that adjunct faculty do so under the direction and supervision of a lead instructor or program coordinator who meets the minimum degree requirement of the rule.
