    PURPOSE AND EFFECT: Provide purpose, general provisions, and other requirements for funding under the Crime Stoppers Trust Fund.

    SUMMARY: This rule provides clarification of the definitions, documentation requirements, and procedures for obtaining grants through the Crime Stoppers Trust Fund.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule the Department, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Cost (SERC) was not necessary and that these rule amendments will not require ratification by the Legislature. This proposed rulemaking will not have an adverse impact or effect regulatory costs in excess of $1 million within five years as established in Sections 120.541(2)(a)1., 2., and 3., F.S.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    2A-9.004 Funding Requirements.

    (1) through (5) No change.

    (6) Mission critical expenses can be paid upon express written approval of the Department, by one Official Member for another, upon written request and provided that:

    (a) The program seeking to make payment has sufficient funds available in the appropriate budget category,

    (b) The program seeking to receive payment has exhausted all alternative payment options, and

    (c) The expense is not included in the budget category of Salary and Benefits.

    2A-9.006 Programmatic and Reimbursement Requirements.

    (1) through (3) No change

    (4) Performance must have taken place within the same grant year as the expenditure; with the exception of maintenance agreements, software license agreements, and subscriptions, and annual advance payments on annual agreements which are $1,800 or less;

    (5) No change.

    (6) The following requirements also apply to reward reimbursements:

    (a) through (c) No change.

    (d) The tip must lead to an arrest, arrest warrant, or recovery of stolen property or drugs. Recovered property does not include guns turned into law enforcement pursuant to a gun buy-back program. Documentation in the form of a law enforcement report, arrest affidavit, arrest warrant, or other certified statement from law enforcement documenting the arrest, issuance of an arrest warrant, or recovery of stolen property or drugs must be kept by the organization and must be available at any time upon request of the Department;

    (e) through (h) No change.

    (7) through (8) No change.
