    NOTICE IS HEREBY GIVEN that on November 14, 2016, the Criminal Justice Standards and Training Commission received a petition for a permanent waiver of subsection 11B-27.002(4), F.A.C., from Chief Rick Thomas of the Howey in the Hills Police Department on behalf of Matthew S. Heald. Petitioner wishes to permanently waive that portion of the Rule that states: Within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that between February 13 and October 10, 2012, Mr. Heald successfully completed a Commission-approved Basic Recruit Training Program and received a passing score. Petitioner further states that on January 4, 2013, Mr. Heald achieved a passing score on the State Officer Certification Examination. Mr. Heald then sought employment with Petitioner, completing a majority of the pre-employment screening process; however, Mr. Heald was not hired prior to February 13, 2016. According to Petitioner, it was Petitioner’s own error in miscalculating Mr. Heald’s hiring deadline date that led to the passing of Mr. Heald’s hiring deadline. Petitioner asserts that Mr. Heald would suffer a sever economic hardhsip should the waiver not be granted, as Mr. Heald would, though no fault of his own, be required to forego employment and pay for and complete another training program, the State Officer Certification Examination, and a second round of pre-employment screening.
