    NOTICE OF CORRECTION

    Notice is hereby given that the following corrections have been made to the Notice of Proposed Rulemaking (NPR) published in Vol. 41, No. 234, December 4, 2015 issue of the Florida Administrative Register.

     

    The  SUMMARY for the NPR contains language that indicates DH Form 1107, 9/14 edition, is being updated by the rule to allow security scanner radiation machine registrants to “verify” that registered security scanner machines are in compliance with ANSI /HPS N423.17-2009 edition. The term “verify” in this Summary is removed and replaced with the term “acknowledge” to conform to the language used in the revised form.

     

    The SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION published in the NPR is hereby completely replaced with the following:

     

    The agency has determined that this rule will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Agency conducted an analysis of the proposed rules to determine if a SERC would be required for them or any one of them. The agency determined through that analysis that the rules will not have an adverse impact on small business nor will there be an increase, direct or indirect, in regulatory costs imposed by the rules. Any person who wishes to provide information regarding the statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

     

    Rule 64E-5.502: The proposed text in the NPR does not account for paragraphs (1) (b) and (c), through sub sections (2) and (3). After renumbered text subparagraphs 64E-5.502 (1) (a) 8. through 11., the corrected coding reads for the rest of this rule section:

     

    (b) through (3) No change.

     

    Rule 64E-5.511(5)(c) [sic]: The proposed text in the NPR for this rule section refers to paragraphs (5)(b) through (c) as No change. There is no paragraph (5)(c) in this rule section. The corrected coding reads: (b) No change.

     

    Except as stated herein, there are no more corrections in this notice.
