NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Gregory R. Eisinger, Esq., In Re: International Village Association, Inc., Docket No. 2014007897, on February 25, 2014. The following is a summary of the agency’s declination of the petition:
The Division declined to issue a Declaratory Statement because it cannot interpret an association’s ambiguous governing documents; or issue a statement that would result in broad statements of policy that apply to a whole class of people; or answer questions that require fact finding beyond the scope of the Division’s authority. The order was filed with the Agency Clerk on April 24, 2014.
