NOTICE IS HEREBY GIVEN that the Board of Pharmacy has issued an order disposing of the petition for declaratory statement filed by Cynthia Mikos, Esquire, on behalf of Timothy Hendrix, M.D., Jonathan Schwartzman, D.O., Anna Pitts, A.R.N.P., Adventist Health System/Sunbelt, Inc. d/b/a Centra Care on July 20, 2015. The following is a summary of the agency's disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 41, No. 20, of the January 30, 2015, Florida Administrative Register. The Petitioners sought a Declaratory Statement from the Board with regard to Section 465.0276(2)(c), F.S., and sought the Board’s interpretation as to whether an electronic version of a prescription written by a qualified practitioner with a dispensing registration issued by the Department of Health which is stored in an electronic medical records system satisfies the requirement of Section 465.0276(2)(c), F.S. The Board of Pharmacy considered the Petition at a duly-noticed public meeting held on April 6, 2015, in Tampa, Florida and June 9, 2015 in Lake Buena Vista, Florida. After discussion regarding the merits of the Petition, Petitioners moved to withdraw the Petition for Declaratory Statement. The Board’s Order, filed on July 15, 2015, granted the request to withdraw the Petition for Declaratory Statement and dismiss the cause.
