    Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed on behalf of Lawrence S. Halperin, M.D, and Covalent Medical, LLC, on August 27, 2014. The Petitioners seek the Board’s interpretation of Section 456.053, F.S., with regard to Patient Self-Referral Act. Specifically, the Petitioners request that the Board find that the “Supplement” outlined in the Petition does not constitute a “health care item” and that Florida physician investors may refer patients for the Supplement and may sell the Supplement in Florida without violating the prohibitions set forth in Section 456.053, F.S. The Board will consider this petition at its meeting currently scheduled for October 10, 2014. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
