53ER13. Emergency Rule For Year 2013 |
1(1) The Florida Lottery will conduct, as a retailer sales incentive, a 13MEGA MILLIONS® 15Retailer 16Bonus Commission Program (“Program”) 20in which the Florida Lottery will award bonus commissions to 30Florida Lottery 32retailers that sell a winning jackpot 38MEGA MILLIONS 40ticket for a 43Tuesday 44or 45Friday 46MEGA MILLIONS 48drawing.
49(2) 50The bonus com53mission will start at $10,000 59for a $12 million starting jackpot65. 66In the event no winning jackpot ticket is sold for 76a MEGA MILLIONS 79drawing, the bonus commission amount will increase by $5,000 per 90drawing until a winning jackpot ticket is sold, 98up to a maximum bonus commission of $106100,107000. 108An additional $5,000 bonus commission will be paid to the retailer if the winning jackpot ticket was a MEGA MILLIONS with Megaplier® ticket.
132(3) 133If multiple winning jackpot tickets are sold 140in Florida 142for the same 145MEGA MILLIONS 147drawing, the retailers selling such tickets will share the bonus commission158s159. Each retailer selling a winning jackpot ticket will receive a share of the bonus equal to the number of winning jackpot tickets sold by that particular retailer divided by the total number of winning jackpot 195tickets sold 197in Florida 199for that drawing.
202(4) Florida Lottery retailers who sell a 209MEGA MILLIONS 211with Megaplier 213ticket that wins $1,217000,000 219for matching 5222+0 numbers 224will receive a $1,000 229bonus commission.
231(2325233) 234Award of a bonus commission is not dependent upon the 244MEGA MILLIONS 246winning jackpot ticket being claimed by the winner.
254(2556256) 257Retailers whose Florida Lottery contracts are terminated or inactivated prior to the bonus commission award shall be paid the bonus commission earned provided said termination or inactivation was not due to noncompliance with Chapter 24, 292F.S293., 294Chapter 53, 296F.A.C. 297or contract terms.
300(3017302) 303A bonus commission will be considered compensation to the retailer for Inte315rnal Revenue Service purposes. 319The Florida Lottery reserves the right to apply a bonus commission earned against a retailer’s outstanding debt to the Florida Lottery, and to award the remaining balance of 347the bonus commission, if any.
352(3538354) 355MEGA MILLIONS 357bonus commissions are subject to availability of funds appropr366iated for retailer incentives. 370This Program is subject to cancellation by future emergency rule if retailer incentive funding is not appropriated or if the Florida Lottery determines that it is no longer in the state’s best interest to u405se such funds for this purpose.
